Kenya Copyright Law 2001 No system yet

Copyright Act (2001) gives rightsholders an exclusive right to control the reproduction, or distribution to the public of a work by way of sale, rental, lease, hire, loan. The Act requires a collecting society to be set up to license use of works.

Kosovo Copyright Law 2011 No system yet

New copyright law in 2011 provides for PLR. Not an exclusive right (apart from computer programs and databases) and does not apply to school libraries. Authors to receive payment for lending out of their works and to be run by a CMO.

Malawi Copyright Act Draft Scheme

New Copyright Act got through Parliament Jan 2017 recognising lending rights.

March 2017: Government  working on draft PLR scheme. PLR to be funded directly by central government,  to be run by a CMO, to be paid to authors and publishers and payments to be based on book loans from pub libraries.

Mauritius Enacted 1999 No system yet

The Mauritius copyright legislation includes provisions for PLR but so far the government has not given effect to these provisions.

According to IFLA, in Moldova, conforming to a new draft law, libraries without commercial interest have been exempted from PLR payments.

Amendment to copyright legislation in 1997 implemented Lending Right Directive.

Portuguese law still excludes public libraries from PLR despite ECJ court ruling in 2006. Therefore no system in place. SPA has appealed to the European Commission.

Romania Copyright Law No system yet

Lending Directive implemented but public libraries excluded from PLR. Draft of revised Copyright Law in 2016 include PLR provisions but final version that went to Parliament in 2017 did not have PLR.

Copyright law currently under review by parliament and proposals for PLR being supported by Prolitteris.

New draft Turkish copyright law requires government to pay equitable remuneration to publishers and authors for loans of books by public libraries. School libraries exempt. Lending by University libraries to be subject to licence payable to to authors and publishers.
